Terms of Use

Welcome to Flowy. These Terms of Use (the “Terms”) govern your access to and use of the Flowy website at www.tryflowy.ai, our applications, and the related services we provide (together, the “Service”).
The Service is operated by Flamingos Technologies Inc. (“Flowy”, “we”, “us”, or “our”). By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Service.
If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization, and “you” refers to that organization. Questions about these Terms? Email us at contact@tryflowy.ai.
1. What Flowy is
Flowy is an AI-native creative platform. It provides an infinite node canvas where you generate, connect, and composite images, video, audio, 3D, vector, and text into finished creative work; a Studio timeline mode for editing those generations into video; AI assistants that can plan and build your work for you; tools to build and apply brand kits; a community for sharing and remixing templates; and collaboration features such as shared workspaces, live presence, and project sharing.
Generations on the Service are produced using artificial-intelligence models, some of which are operated by third-party providers (see “Third-party services and AI providers” below). The Service is metered in credits, and certain features are offered on paid plans.
Flowy is under active development. We add, change, and remove features, and some capabilities may be offered as experimental, beta, or “Labs” features that are still evolving and may not work as expected.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use the Service. The Service is not directed to children, and we do not knowingly allow anyone under 18 to create an account.
By using the Service, you represent and warrant that: you meet the age requirement; the information you provide is accurate; you are not barred from using the Service under the laws of any applicable jurisdiction (including export-control and sanctions laws); and your use of the Service complies with all laws that apply to you.
3. Your account
You sign in to Flowy using a supported single sign-on provider (such as Google or GitHub) or an email “magic link” — there is no password. You are responsible for maintaining the security of the email account and identity providers you use to access Flowy, and for all activity that occurs under your account.
You agree to provide accurate account information and to keep it up to date, to use the Service as an individual identified to us (not to share a single account among many people in a way that circumvents plan limits), and to notify us promptly at contact@tryflowy.ai of any unauthorized use of your account or other breach of security. We are not liable for any loss arising from unauthorized use of your account, and you may be liable for losses we or others incur as a result.
4. Plans, credits, billing, and cancellation
Access to certain features requires a paid plan and/or the purchase of credits. Credits are the unit Flowy uses to meter generations and other compute-intensive actions; each action consumes a number of credits that we may change from time to time as model and infrastructure costs change.
Payments are processed by our third-party payment processor (Stripe). By purchasing a plan or credits, you authorize us and our processor to charge your selected payment method for the applicable fees, plus any taxes. Paid subscriptions renew automatically for successive billing periods until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the then-current billing period, and you retain access until that period ends.
Except where required by applicable law, all fees and credit purchases are final and non-refundable, and credits are non-refundable once purchased, including for unused credits, partial billing periods, or features you did not use. Credits have no cash value, are not transferable, and may expire as described at the point of purchase or in your plan.
We may change our prices, plans, and credit costs prospectively. If we change the recurring fees for a subscription you hold, we will give you reasonable advance notice, and the change will apply to your next billing period. If a payment fails, we may suspend or downgrade your access until payment is resolved.
5. Your content and inputs
“User Content” means everything you provide to or create on the Service that did not originate from us — including prompts and instructions, files and media you upload, brand assets and reference material, website URLs you submit for brand-kit extraction, canvas and timeline data, comments, and the AI-generated media that results from your use of the Service (“Outputs”).
As between you and Flowy, you retain the ownership rights you hold in your User Content. You are solely responsible for your User Content and for ensuring you have all rights, licenses, and permissions necessary to provide it to us and to use it on the Service. You represent and warrant that your User Content, and our use of it as permitted by these Terms, does not infringe or violate the rights of any third party or any law.
6. AI-generated Outputs and license to Flowy
Subject to your compliance with these Terms and to the terms of any third-party model providers, and as between you and Flowy, you own the Outputs you generate on the Service, and you are free to use them, including for commercial purposes. We make no claim of ownership over your Outputs beyond the license described below.
To operate, secure, support, promote, and improve the Service, you grant Flowy a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for technical purposes such as formatting and creating thumbnails), publicly display and perform, and otherwise use your User Content and Outputs. This license includes using your User Content and Outputs to provide collaboration and sharing features you enable, to develop and improve our products and models, and — where you have made content public (for example by publishing a community template) — to display and promote that content. This license ends when you delete the relevant content or close your account, except for content you shared publicly or with others who retain it, content retained in backups for a limited period, and rights that by their nature survive (such as our use of de-identified or aggregated data).
Please understand how generative AI works: Outputs are produced by probabilistic models, may not be unique to you, and similar or identical Outputs may be generated for other users. We do not guarantee that any Output is original, accurate, fit for any purpose, eligible for copyright or other protection, or free of third-party rights. You are responsible for reviewing Outputs and for determining whether they are suitable and lawful for your intended use.
7. Acceptable use
You agree not to use the Service, and not to use any Output, to do or attempt any of the following:
- Violate any law or regulation, or infringe or misappropriate any patent, copyright, trademark, trade secret, publicity, privacy, or other right of any person.
- Create, upload, or generate child sexual abuse material, non-consensual intimate imagery, or any content that sexualizes minors.
- Generate deceptive deepfakes, impersonate any real person, or create content intended to defraud, mislead, or harm — including disinformation, scams, or content falsely presented as authentic.
- Produce or distribute content that is unlawfully hateful, harassing, defamatory, or that incites violence or self-harm, or that depicts or facilitates serious harm.
- Upload or generate malware, or use the Service to probe, scan, breach, or disrupt any system, network, or security feature.
- Reverse engineer, decompile, scrape, or use automated means to access the Service except via interfaces we provide; resell, sublicense, or commercially exploit the Service itself; or use the Service or Outputs to build, train, or improve a competing product or model.
- Circumvent or attempt to circumvent credit metering, rate limits, usage quotas, access controls, or plan restrictions.
- Submit User Content you do not have the rights to submit, or use the Service in any way that violates the terms of a third-party provider whose models or services power a generation.
We may, but are not obligated to, review, screen, refuse, or remove any content, and may use automated and manual moderation. We may report unlawful content to authorities as required by law.
8. Collaboration, sharing, and community
Flowy lets you collaborate in shared workspaces, invite others with assigned roles, share projects, and publish or remix templates in the community. Content you share with collaborators or publish publicly may be viewed, used, copied, or remixed by those who can access it, and we are not responsible for how they use it. You are responsible for what you choose to share and for managing access to your workspaces and projects.
If you publish or remix community templates, you represent that you have the right to do so and grant other users the rights necessary to view and remix what you publish, consistent with these Terms.
9. Third-party services and AI providers
The Service integrates third-party services, including AI model and infrastructure providers (such as FAL, Replicate, and Anthropic), cloud storage and hosting providers, our payment processor (Stripe), identity providers used for sign-in (such as Google and GitHub), and analytics and communication tools. When you run a generation, your prompts and inputs may be transmitted to and processed by these providers to produce Outputs.
Your use of third-party services may be subject to their own terms and policies, and those providers may impose restrictions on permitted inputs and uses of Outputs. We do not control and are not responsible for third-party services, and we are not liable for their acts, omissions, availability, or content. Our Privacy Policy describes how data is shared with these providers.
10. Our intellectual property
The Service — including its software, design, user interface, models and pipelines we develop, text, graphics, and the Flowy name and logos — is owned by Flamingos Technologies Inc. or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal or creative purposes. We reserve all rights not expressly granted. You may not use our names, logos, or trademarks without our prior written permission.
If you send us feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without obligation to you.
11. Service availability and changes
We work to keep the Service available and reliable, but we provide it on an “as available” basis and do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service, perform maintenance, or impose limits, at any time. We are not responsible for any loss of User Content, Outputs, or other data; you are responsible for keeping your own copies of anything important to you.
Beta, experimental, and “Labs” features are provided for evaluation, may be changed or withdrawn at any time, and may be less stable than generally available features.
12. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access — in whole or in part, with or without notice — if we reasonably believe you have violated these Terms or the law, to protect the Service or other users, or if required to do so. We may also terminate or suspend the Service generally.
Upon termination, your right to use the Service ends and we may delete your account and associated content, subject to our Privacy Policy and applicable law. Sections that by their nature should survive termination — including ownership, licenses you have granted, disclaimers, limitations of liability, indemnification, and governing law — will survive.
13. Disclaimers
THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE, RELIABLE, ORIGINAL, OR SUITABLE FOR ANY PURPOSE.
AI-generated Outputs may be inaccurate, incomplete, offensive, or inappropriate, and may inadvertently resemble existing works. You are solely responsible for evaluating Outputs and for any decisions you make or content you publish based on them. Some of these disclaimers may not apply to you to the extent prohibited by the law of your jurisdiction.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLAMINGOS TECHNOLOGIES INC. AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR CONTENT, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
15. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Flamingos Technologies Inc. and its affiliates and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your Outputs, your use of the Service, or your violation of these Terms or any law or third-party right.
16. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Subject to any mandatory consumer-protection rights you have under the law of your home jurisdiction, you and Flowy agree that the state and federal courts located in San Francisco, California will have exclusive jurisdiction over any dispute arising from these Terms or the Service.
Before filing a claim, you agree to first contact us at contact@tryflowy.ai and attempt to resolve the dispute informally; we will try to do the same. Nothing in this section limits any right you may have to bring a complaint before a regulator or to seek any remedy that cannot be waived under applicable law.
17. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you through the Service or by email. Changes take effect when posted unless stated otherwise, and your continued use of the Service after changes take effect means you accept the revised Terms. If you do not agree to the changes, you should stop using the Service.
18. General
These Terms, together with our Privacy Policy and any plan-specific terms, are the entire agreement between you and Flowy regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms do not create any third-party beneficiary rights.
